These Terms and Conditions were last updated on January 10th, 2023 and are considered effective as amended as of this date.



1. Terms and Confitions

The following are the Terms and Conditions (the "Agreement") which govern your access and use of our online platform through which therapy may be provided (collectively the "Platform"). This website is owned and operated by Let It located at Šubćeva 42.//III 10000, ZAGREB, Croatia ([email protected] it.net). The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website let-it.net and its related apps.

By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound to any term of this Agreement, you must not access the Platform.

When the terms "we", "us", "our" or similar are used in this Agreement, they refer to any company that owns and operates the Platform (the "Company").

2. Privacy and Security

Protecting and safeguarding any information you provide through the Platform is extremely important to us. Information about our security and privacy practices can be found on our Privacy Policy available at https://www.let-it.net/privacy (The ‘Privacy Policy’). BY AGREEING TO THIS AGREEMENT AND/OR BY USING THE PLATFORM, YOU ARE ALSO AGREEING TO THE TERMS OF THE PRIVACY POLICY. THE PRIVACY POLICY IS INCORPORATED INTO AND DEEMED A PART OF THIS AGREEMENT. THE SAME RULES THAT APPLY REGARDING CHANGES AND REVISIONS OF THIS AGREEMENT ALSO APPLY TO CHANGES AND REVISIONS OF THE PRIVACY POLICY.

Please read the Terms and Conditions carefully before using the Platform. Your access to and use of the Platform is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Platform you agree to be bound by the Terms and Conditions. You are not allowed to use the Platform if you disagree with any part of the Terms and Conditions.

You confirm that you are over the age of 18, legally able to consent to receive the Counselor Services, and legally able to enter into an agreement.

You should always talk to an appropriately qualified health care professional for diagnosis and treatment, including information about appropriate medications or treatment for you. None of the content on the Platform or provided by the Counselor represents or warrants that any particular medication or treatment is safe, appropriate, or effective for you. The Company does not approve any specific tests, medications, products or procedures.

3. The Platform

The Platform as well as any information text, graphics, photos or other materials uploaded, downloaded or appearing on the Platform is available at the Company’s website.

The Platform shall be used to connect you with a Counselor who will provide services such as counseling, consulting and professional advice to you through the Platform.

Other than the guidance and advice you receive directly from the Counselor, the other educational, graphics, research sources and other incidental information on the Platform should not be considered medical advice.

The Platform shall be provided "as is" without any express or implied warranties of any kind, including but not limited to merchantability, non-infringement, security, fitness for a particular purpose or accuracy. To the fullest extent permissible pursuant to applicable law, the Company expressly disclaims all warranties of any kind, whether expressed or implied.

At any time and for any reason, or for no reason at all the Company may, with or without prior notice, modify, suspend, disrupt or discontinue (i) the Platform, (ii) any part of the Platform, or (iii) the use of or access to the Platform, whether to all users or to you specifically. Further, the Company is entitled, but is not obligated to refuse to provide access to the Platform to any person, agency or organization at any time, for any reason or for no reason at all, in its sole discretion. The Company reserves the right to without prior notice change, suspend, or discontinue all or part of the Platform, temporarily or permanently. The Company will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.

The Company will make commercially reasonable efforts to ensure the Platform’s reliability and accessibility. However, no platform can be 100% reliable and accessible and the Company does not warrant that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times, or that any eventual defects will be corrected.

4. PSYCHOTHERAPY

Psychotherapy is a process during which, through the relationship with the therapist and focusing on a better understanding of the intrapsychic, the resolution of suppressed conflicts and the improvement of integrative processes is influenced. In this way, a higher level of harmony of feelings, thoughts and behavior is gradually achieved, which results in mastering difficulties, more adequate adaptation and better quality relationships.

Psychotherapy can be short-term or long-term. Some approaches are oriented towards treating and relieving symptoms and addressing behavior and cognition. The goal of some other approaches is to bring about a change in a person's emotional development, in a way that takes into account aspects of the individual's inner world of which the person in question may be unaware, and to help him understand and change deep and often unconscious emotional problems and difficulties in relationships. Different approaches can be adapted depending on the problem or the client's preference.

The relationship with the client is a key element of any psychotherapy. A psychotherapist should offer a confidential and private environment in which difficult experiences can be safely explored and processed. Current theoretical and empirical research confirms the importance of the psychotherapeutic relationship as a key factor influencing the success of psychotherapy.

PLATFORM IS NOT DESIGNED FOR USE IN ANY OF THE AFOREMENTIONED CASES AND THE THERAPISTS CANNOT PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE AFOREMENTIONED CASES.

THE PLATFORM IS NOT INTENDED FOR THE PROVISION OF CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION AND YOU SHOULD NOT USE IT IF YOU NEED ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED THERAPY OR EMOTIONAL SERVICE DOG CERTIFICATION. IT IS ALSO NOT INTENDED FOR ANY INFORMATION REGARDING WHICH DRUGS OR MEDICAL TREATMENT MAY BE APPROPRIATE FOR YOU, AND YOU SHOULD DISREGARD ANY SUCH ADVICE IF DELIVERED THROUGH THE PLATFORM.

5. Your Use of the Platform

Your use of the Platform and your reliance upon any of its contents is solely at your risk.

You are aware that in order to access and use the Platform, you must provide truthful information about your age, residence and Emergency Contact. The Counselor you access depends on this certification in order to interact with you and provide the Counselor Services.

All information you have provided, or will provide in the future, in or through the Platform shall be true, accurate, current and complete. Additionally, you shall during the term of these Terms and Conditions make sure to maintain and update the information in order to continue to be true, accurate, current and complete.

You shall not access or use the Platform or the Counselor Services in an unlawful way or for an unlawful or illegitimate purpose or in any manner that contravenes these terms.

You undertake not to post, send, use, store, transmit or deliver either of the following on and through the Platform:

(i) messages or information under a false name;

(ii) unsolicited e-mail and/or advertisement or promotion of goods and services;

(iii) malicious software or code;

(iv) information that is unlawful, libelous, defamatory, fraudulent, predatory of minors, harassing, privacy invading, abusive, threatening or hateful, vulgar, obscene, racist or potentially harmful content;

(v) any content that infringes a third party right including intellectual property rights of others or the privacy or publicity rights of others;

(vi) any content that may cause damage to a third party; or

(vii) any content which may constitute, cause or encourage a criminal action or violate any applicable law.

6. Intellectual Property

All content available on or through the Platform shall be the property of the Company or its licensors, and shall be protected by copyright, trademark, patent, trade secret and other intellectual property law.

The Platform is subject to various factors such as, but not limited to, software, hardware and tools, either the Company’s or those owned and/or operated by the Company’s contractors and suppliers.

You undertake not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received through the Platform to any third party. All software and accompanying documentation made available for download through the Platform is the copyrighted work of the Company or its licensors. Any copy made of information obtained through the Platform must include all applicable copyright notices.

7. Your account, representations, conduct and commitments

You hereby confirm that you are legally able to consent to receive Services, or have the consent of a parent or guardian, and are legally able to enter into a contract. Minor Consent: Where consent from a parent or guardian is required to receive Services, you hereby confirm that as the consenting parent or guardian, you have the sole right to consent to Services for the minor seeking therapy and are not legally mandated to confer with or get consent from any other legal guardian before consenting. You also give affirmative consent to the provisions set forth in the accompanying Privacy Policy regarding the collection, process, and use of personal information on behalf of the minor. You also agree that consent to Services remains valid until membership is canceled. You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of this Agreement you will make sure to maintain and update this information so it will continue to be accurate, current and complete.

You agree and confirm that your use of the Platform, including the Therapist Services, are for your own personal use only and that you are not using the Platform or the Therapist Services for or behalf of any other person or organization.

You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform's systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned.

You agree and commit not to make any use of the Platform for the posting, sending or delivering of either of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content; (d) any content that infringes a third party right including intellectual property rights; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause or encourage a criminal action or violate any applicable law.

You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the Therapists and us.

If you receive any file from us or from a Therapist, whether through the Platform or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.

You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys' fees and expenses) arising out of or relating to any of the following: (a) your access to or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your violation of any of the provisions of this Agreement; (d) non-payment for any of the services (including Therapist Services) which were provided through the Platform; (e) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive expiration or termination of this Agreement. You confirm and agree to use only credit cards or other payment means (collectively “Payment Means”) which you are duly and fully authorized to use, and that all payment related information that you provided and will provide in the future, to or through the Platform, is accurate, current and correct and will continue to be accurate, current and correct. You agree to pay all fees and charges associated with your Account on a timely basis and according to the fees schedule, the terms and the rates as published in the Platform. By providing us with your Payment Means you authorize us to bill and charge you through that Payment Means and you agree to maintain valid Payment Means information in your Account information.

Modifications, Termination, Interruption and Disruptions to the Platform

You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.

The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.

8. PROCEEDING IN RISK SITUATIONS

If the psychotherapist assesses that the client shows signs of behavior that is not safe to treat without the supervision of a psychiatrist and drug therapy, or notices that the client needs a higher level of examination and treatment, he must proceed according to the protocol. Problems that are also not treated are disorders for which the psychotherapist judges that you cannot independently conduct psychotherapy with the client outside the clinical conditions of treatment.

In case the psychotherapist finds himself in a situation where the client he is working with shows signs of suicidal thoughts, threatens suicide or shows signs of a clinical form of depression, he needs to inform the supervisor about the situation, and stop working with the client in the manner described below:

If the situation is critical, you should first of all bring it under control and ask the client if he knows the nearest health facility in his city to which he can contact for urgent and immediate help, if he does not know, in the section of the name of the country, it is necessary to find emergency numbers and share them with the client . Another approach that can be combined with the first one is to advise the client to share his critical situation with a trusted close person and ask for help from a close person to find an adequate treatment for his city. The purpose of informing a close circle of people about the client's situation is to provide him with professional help as quickly as possible.

In an ideal situation, the client should be presented with all the help options, and share information about the emergency numbers they can contact to find help in their country, and then end the session with that explanation.

9. For Minors

The provision of psychotherapeutic services is not intended for minors in this project. In the event that a minor appears at the therapy, or a person who acts as a minor, it is necessary to politely and pleasantly ask the client to show a personal document with the date of birth written on it, in order to prove that they are of age, with the excuse that this is the protocol of the project and that it is not allowed to provide psychotherapy services to minors.

If it turns out that the person is not of legal age, it is not possible to continue the session in the usual way, but by knowing the problem the child is presenting with, he can be directed to seek help at another mental health center in his city, or to turn to a trusted adult in your environment, to help you find it.

If it is established that the person is of legal age, the session must be started in the usual way.
